Motor Vehicle Accident Blogs

In order to pursue compensation after a motor vehicle accident, a plaintiff usually must show that the defendant was driving negligently. The first two elements of a negligence claim are duty and breach. Each driver has the obligation to operate his or her vehicle with the same ordinary care and skill that a reasonably prudent driver would use in a similar situation, taking into account the current weather and road conditions as well as obeying traffic laws. To establish a breach, the victim must show that the defendant failed to act according to the duty of care. The third element of a negligence claim, causation, requires a plaintiff to prove that he or she would not have been harmed but for the defendant’s breach. Finally, the victim must provide evidence of the damages that he or she suffered, often including medical expenses, physical therapy, lost wages, loss of future earning capacity, property damage, and pain and suffering.
